CONQUR AI TERMS OF USE

PLEASE READ THESE TERMS CAREFULLY AS THEY DESCRIBE YOUR RIGHTS AND RESPONSIBILITIES AND FORM A LEGALLY BINDING AGREEMENT BETWEEN YOU AND CONQUR AI PRIVATE LIMITED ("CONQUR AI," "WE," OR "US") REGARDING YOUR USE OF CONQUR AI'S WEBSITES AND SERVICES.

These Terms of Use govern your access to and use of Conqur AI’s products, analytics tools, APIs, and related websites (collectively, the “Services”).

By using or accessing the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, along with our Privacy Policy. If you do not agree, please do not use or access the Services.

1. Access and Use of the Services

1.1 Sale of Services

Subject to your compliance with these Terms or any separate agreement, you may access and use our Services. You must comply with our Privacy Policy, usage documentation, and all applicable Indian laws. We may modify or discontinue the Services with reasonable notice.

1.2 Eligibility and Access

You must be at least 18 years of age to use our Services. You agree not to copy, modify, or distribute the Services or any part of it except as expressly permitted.

1.3 Use Restrictions

• (i) Violate any applicable law, intellectual property right, or proprietary right;
• (ii) Use bots or automated scraping tools to extract data;
• (iii) Reverse engineer, decompile, or discover the underlying code or algorithms;
• (iv) Upload unlawful, misleading, harmful, or obscene material;
• (v) Impersonate others or misrepresent your affiliation;
• (vi) Circumvent or disable security features of the Services;
• (vii) Remove proprietary notices or license terms; or
• (viii) Use the Services to create competing products, datasets, or analytics engines.

1.4 Account Registration

To use certain features, you may need to create an account. You are responsible for all activity under your account and must keep credentials secure. Notify us promptly of unauthorized access.

1.5 Updates

Conqur AI may release updates or enhancements. Some may install automatically to ensure functionality and security.

1.6 Ownership

Conqur AI retains ownership of all intellectual property rights in the Services. Any feedback you provide may be used by us without restriction or compensation.

1.7 Third-Party Services

Our Services may use or display third-party APIs, software, or data (“Third-Party Services”). Use of such services is subject to their respective terms, and Conqur AI is not responsible for them.

2. Content and Data Usage

2.1 Your Content

You may provide input (“Input”) and receive output (“Output”) from the Services. You own your Input and Output, and we assign to you any rights we may have in the Output, to the extent permitted by law.

2.2 Similar Output

Because of how AI models operate, Output generated for you may be similar or identical to Output generated for other users.

2.3 Use of Your Content

We may process Content to operate, improve, and secure our Services. You may opt out of training-related data use by emailing hello@conqur.ai.

2.4 Aggregated and Analytics Data

Conqur AI may collect and process anonymized, aggregated usage and analytics data (“Aggregated Data”) to enhance and analyze its Services. Aggregated Data will not include personally identifiable or confidential information.

2.5 AI-Generated Output Disclaimer

The Services may produce AI-generated insights or suggestions. Such Output may not be accurate, complete, or current. You are solely responsible for verifying and using such Output.

3. Fees and Payment

Fees and payment terms are displayed on our Site or in your order form. All fees are due as stated. We may modify fees upon reasonable notice.

4. Intellectual Property

The Services, software, and all intellectual property therein are owned by Conqur AI or its licensors. You may not copy or reproduce any part of the Services without written permission.

5. Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved through good faith discussions between you and Conqur AI.

If unresolved within 30 days, the dispute shall be referred to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator appointed by mutual consent. The seat and venue of arbitration shall be Bengaluru, Karnataka, India, and the proceedings shall be conducted in English.

These Terms and any disputes arising hereunder shall be governed by the laws of India, without regard to its conflict of law principles. Courts in Bengaluru, Karnataka shall have exclusive jurisdiction for any matters not subject to arbitration.

6. Termination

You may stop using our Services at any time. We may suspend or terminate access for violations, compliance reasons, or risk mitigation. We may delete your account data 30 days after termination but retain anonymized data for analysis.

7. Copyright and IP Complaints

If you believe any content on our Services infringes your intellectual property rights, please email us at hello@conqur.ai with all relevant details, including proof of ownership and unauthorized use.

8. Disclaimers and Liability

8.1 Disclaimer of Warranties

The Services are provided “as is” and “as available.” Conqur AI disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

8.2 Limitation of Liability

To the maximum extent permitted under law, Conqur AI shall not be liable for indirect, incidental, consequential, or punitive damages, or for loss of data, profits, or business opportunities. Our total liability shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.

8.3 Indemnity

You agree to indemnify and hold harmless Conqur AI, its affiliates, and employees from any claim, loss, or expense arising from your breach of these Terms or misuse of the Services.

9. Miscellaneous

9.1 Publicity

With your prior written consent, Conqur AI may reference your company name and logo in marketing materials.

9.2 Assignment

You may not assign these Terms without our written consent. We may assign or transfer these Terms to an affiliate or successor entity.

9.3 Amendments

We may update these Terms periodically. Continued use of the Services after updates constitutes acceptance of the revised Terms.

9.4 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
